Pending Rulemaking Proceedings and Proposed Amendments to Regulations

The Director has adopted a regulation governing Volume Cap, NAC Chapter 348A, to require the filing of more detailed information regarding the use of volume cap, including cap that has been carried forward from prior years.  The regulation was approved by the Legislative Commission and became effective on September 18, 2006. The adopted regulation establishes new reporting requirements for local governments and agencies receiving state volume cap.  The reports must be filed with the Office of Business Finance and Planning by February 15th of year following the report year.  The reporting requirement does not apply to local governments whose volume cap allocation reverts to the state by operation of law through non-use.  To aid in reporting this information, the OBFP has created a reporting form in Excel format which you can download here and email to the OBFP.
